These Terms of Use (hereinafter the 'Terms of Use') define the conditions of access to and use of the Diag QVT application (hereinafter the 'Application'). Provided by MAM Sport Santé (hereinafter the 'Company').
The Application will be accessible to employees of a company (hereinafter the 'Client') with a subscription taken out with MAM Sport Santé, the end user of the application is the employee.
The Application is a tool intended to collect, individually and anonymously, information through a questionnaire focusing on your quality of life and working conditions, to combine your answers and those of your colleagues, in order to provide a clear picture of situations and employees' needs and to improve your living and working conditions within your company and in general.
Access to and use of the Application are subject to the unconditional acceptance of these Terms of Use by the employee (hereinafter the 'User'). By accessing the Application, the User acknowledges having read the Terms of Use and accepting them in their entirety.
Access to the Application is reserved for employees of the 'Client' with a unique and anonymous identifier and password, using a magic link with a password generated in a timeless series.
The Company undertakes to make its best efforts to ensure access to the Application 24 hours a day, 7 days a week, except in the event of force majeure, maintenance, or technical incidents beyond its control.
The User undertakes to use the Application exclusively within the individual framework. Any use for personal or commercial purposes outside this framework is prohibited.
The User undertakes not to use the Application in an abusive, fraudulent or unlawful manner, and to comply with the IT security rules laid down by the Company.
The User undertakes to preserve the confidentiality of their login details and not to disclose them to third parties.
As part of the use of the Application, the Company may collect and process anonymized personal data of Users. This data is processed in accordance with the applicable regulations, in particular the General Data Protection Regulation (GDPR). It will be presented in the form of aggregated results, charts, weighted diagrams or otherwise to the Client, without linking your personal responses; your anonymity is strictly guaranteed.
The User has the right to access, rectify, delete and portability of their personal data, as well as the right to object for legitimate reasons. These rights may be exercised by contacting contact@diagqvt.fr.
The Company strives to provide a reliable and secure Application. However, the Company cannot be held liable for direct or indirect damages resulting from the use or inability to use the Application.
The User is solely responsible for their use of the Application and the consequences thereof, particularly in the event of non-compliance with these Terms of Use.
The Company reserves the right to perform maintenance operations, updates or improvements to the Application, which may result in a temporary interruption of access to the Application. The Company will endeavor to limit these interruptions and inform Users in advance.
These Terms of Use may be modified at any time by the Company. Users will be informed of any changes by a message within the Application or by any other appropriate means. By continuing to use the Application after a change to the Terms of Use, the User accepts these changes.
These Terms of Use are concluded for an indefinite period. The User may stop using the Application at any time. The Company reserves the right to suspend or terminate access to the Application in the event of non-compliance with these Terms of Use by the User.
These Terms of Use are governed by French law. In the event of a dispute relating to the interpretation or execution of these Terms of Use, the parties will seek an amicable solution. Failing that, the dispute will be submitted to the jurisdiction of the courts of Rennes.
